well there are lots of reasons for the regs. human contact messes with there natural instincts and there is always the risk of exposing wild birds to captive pathogens amongst others things such as proper diet.

I wonder if a wildlife rehab center could hatch and care for these eggs. they did with those humingbirds although I think they were already hatched and I dont know the final results, I know they had some challenges to over come. these birds are not like chickens and require parental care.

There is no way telling how long these eggs have been in the nest, I haven't seen any activity around, I assume the birds knew the tree was coming down before we did and just abandoned the nest. I am a firm believer in letting nature take it's course. :)
Definitely nobody hanging around wondering what happened to their condo.

Yes illegal, pileated is a protected species, it was endangered and still may be, nasty fine if caught. Plus they must be fed every 3 hours by hand. Go ahead....if you have nothing better to do....
Its early enough the couple will make a new nest.

As I can see Pileated Woodpecker is not listed in Ontario, but the Bobwhite Quail is!
"persons may be fined up to $500,000 and can be imprisoned for up to one year. The maximum fines referred to above may be multiplied by the number of animals, plants or other organisms that are killed, harmed, harassed, or captured during the offence."

Better get a permit if you have Bobwhites. All it takes is a prosecutor looking for a notch on his belt and using you as an example.

I guess we have been very lucky, they have been around here for decades, I have many "holy" trees to prove it.
I wouldn't dream of trying to hatch the eggs, I am sure they will manage without my help. ;)
Oh oh, back to bachelorette turkey on the front lawn, everybody seems to be waiting for my garden, the only thing growing in there now is 6" shoots of garlic.

OC..of course, you must do as you see fit, but had it been me, and this is IMO only, I would have given it a shot...read up on as much as I could and gone whole hog. In matters like this I don't give a crap about the rules. Its dead eggs and nada or possibly a few or one baby pileated. Where's the down side?

It's actually not about the rules, absolutely willing to ignore them when necessary ;)
I feel that setting them would have been a "fool's errand", like Al mentioned exposure or exchange of wild bird pathogens, I can do without,
and I certainly wouldn't be willing to spend the time and money to look after them. The wildlife center has enough on their hands to do without an old woman playing mother Nature adding to their workload.
And of course I would have to throw out the incubator if they actually hatched. :)

$500,000 feels like the downside to me. That's not quite spare change if somehow she gets a fine. First of all, NEVER in print. If it was a consideration for OC before it likely isn't now.
And if it is illegal, there are some good reasons for it, especially when it comes to wildlife.

Anyways. We will do as we do. The laws of physics; with every action, there is a reaction.

The unfortunate reality is that if you do have endangered species on your property, the best thing to do is stay quiet. The whole system is all stick (punishments) and no carrot. Meanwhile tax incentives go to companies that drill holes in the ground, or folks that move money offshore.
