I don't see why you can't give away eggs.
If you are thinking about a Food Bank, for example, the one near me does not accept them because they already have egg vouchers for the local grocery store.

I donate my eggs to my friends and co workers all the time and they leave $4 on my desk at school as a donation for my chicken sanctuary.

Cheers,

I could not find anything on the internet, but I would say it would be similar rules to farm gate sales, since you are really just selling them really, really cheap.... cannot take off our your property, must be picked up at your property by the person "buying" them. If you are talking about donating to food bank or something, I am guessing most would not accept them due to liability risk of distributing ungraded eggs.

But I could be totally wrong, it happens once or twice a year. lol

Thanks Jim. I just looked up farm gate sales, now that I know that term. Found a couple of pdf files for my area.

I think it depends where you are giving them. I tried to donate to the food bank when I had all the chcikens. I would rather of donated them than sold them. But if I wasn't FDA inspected etc., then they couldn't take them. Very frustrating! I was livid and the mgr tried to find away around it, but wasn't able too. I was too far for people to come and get eggs. Very disappointing.
